1. Acceptance of Terms

By downloading, installing, or using the speakeasy mobile application ("App") or visiting our website at speakeasy.studio.gold ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.

2. Description of Service

speakeasy is a text-to-speech application that converts web articles and other text content into audio using artificial intelligence. The App allows you to submit URLs, extract article content, generate audio versions, and listen to them on your device.

3. Use License

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes subject to these Terms. You may not modify, distribute, or create derivative works based on the App.

4. Subscriptions and Payments

speakeasy offers the following subscription plans:

  • Monthly: $9.99 per month
  • Yearly: $89.99 per year (equivalent to $7.50 per month)

Payment: Payment will be charged to your Apple ID account or iTunes Account at confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Managing Subscriptions: You can manage and cancel your subscriptions by going to your Account Settings on your device after purchase.

Cancellation and Refunds: No cancellation of the current subscription is allowed during the active subscription period. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription. Refund requests are subject to Apple's refund policies.

Free Features: Certain features of the App are available without a subscription, subject to weekly usage limits.

5. Content and Audio

speakeasy generates audio from text content using text-to-speech technology. You acknowledge that:

  • Audio is generated by artificial intelligence and may not perfectly reproduce the source content.
  • You are responsible for ensuring you have the right to convert any content you submit to the App.
  • Generated audio is for your personal use only and may not be redistributed or used commercially.
  • We do not claim ownership of the content you submit or the audio generated from it.
  • We are not responsible for the accuracy, completeness, or legality of any third-party content you submit for conversion.

6. Disclaimer

The App and all materials are provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitations of Liability

In no event shall speakeasy, its operators, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App, even if we have been advised of the possibility of such damages.

8. Intellectual Property

All content included in the App and Website, such as text, graphics, logos, icons, and software, is the property of speakeasy or its content suppliers and is protected by intellectual property laws. The speakeasy name and logo are trademarks of Gold Studio.

9. User Accounts

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California.
